Administrative Methods for China (Tianjin) Pilot Free Trade Zone
Chapter I General Provisions
Article 1 These Methods are enacted in accordance with the Decision of the Standing Committee of the National People’s Congress on Authorizing the State Council to Temporarily Readjust the Administrative Examination and Approval of the Relevant Laws and Regulation in the China ( Guangdong) Pilot Free Trade Zone, China (Tianjin) Pilot Free Trade Zone, China (Fujian) Pilot Free Trade Zone and the Extended Area of China (Shanghai) Pilot Free Trade Zone, Reply by the State Council on Assenting the Setting Up of China (Tianjin) Pilot Free Trade Zone (Letter No. 177  of the State Council)), the Overall Plan for China (Tianjin ) Pilot Free Trade Zone (No. 19 Document in 2015 of the State Council.) and with related laws and regulations, with the purpose of pushing forward and guaranteeing the construction and development of China (Tianjin) Pilot Free Trade Zone.
Article 2 These Methods apply to China (Tianjin) Pilot Free Trade Zone (hereinafter referred to briefly as PFTZ) . The PFTZ covers a total area of 119.9 square kilometers embracing the Tianjin Harbor, Tianjin Airport and CBD of the Binhai New Area, and is divided into the special custom monitored area and non-special customs monitored area.
Article 3 The PFTZ shall develop into a first class international free trade zone characterized by freedom in trade, convenience in investment, a concentration of upper-end industries, perfect financial service, standardized legal environment, efficiency and ease of monitor and administration, pronounced function of radiation and powerhouse. The PFTZ shall play a demonstration role and serve as driving force in the coordinated development of the Beijing, Tianjin and Hebei area and in the economic development by shifting the mode of production.
Article 4 The Tianjin Harbor section shall focus on shipping and logistics, international trade, financing lease and other modern services. The Tianjin Airport section shall be devoted to developing productive services such as air and space industry, equipment manufacturing, high-end manufacturing and R&D design by using information technology of next generation and air logistics. The CBD of Binhai New Area section shall be devoted to the development of modern service led by financial innovation.
In the special customs monitored area, research shall be done in the field of system innovation with the focus on trade, open businesses in commodities trade, financing and leasing, bonded processing and logistics. In the non- special customs monitored area in the PFTZ, research shall be done in the field of reform in the investment system, innovation in finance with the aim of actively developing modern service and high-end manufacturing industries.
Article 5 A leading group shall be set up to push forward the China(Tianjin) Pilot Free Trade Zone ( hereinafter referred to briefly as the group), to take charge of the reform as a whole in the PFTZ, study and decide on major matters concerning the PFTZ. The office of the group is set up in the Municipal commercial commission to take care of the day-to-day work of the group.
An administrative commission of the China (Tianjin) Pilot Free Trade Zone (hereinafter referred to briefly as the administrative commission) shall be set up to coordinate, in accordance with the decision, and arrangement of the group, in a unified way and organize the implementation of the reform and innovation tasks in the PFTZ and study and evaluate the reform and innovation measures in the PFTZ.
The relevant departments of the Municipal People’s Government and the Binhai New Area people’s government shall, depending on their duties and responsibilities, support the work of the administrative commission and undertake the other administrative matters in the PFTZ.
Chapter II Management System
Article 6 The administrative commission shall, as required by the demands of building a rule of law and service type government, renovate the way of management, upgrade the level of administration, formulate a service system that complies with the demands of internationalization, marketization, rule of law and characterized by freedom, convenience in trade and investment.
Article 7 The administrative commission shall fulfill the following duties and responsibilities:
1. Organizing the implementation of the reform and innovation measures in the PFTZ;
2. Making suggestions on the policies for deepening the reform and innovation in the PFTZ;
3. Organizing the post-evaluation of the reform and innovation measure in the PFTZ;
4. Assisting in drafting relevant policies and regulations for the PFTZ;
5. Coordinating the administrative work in the PFTZ in the field of investment, trade, financial service, planning, statistics;
6. Coordinating the relevant work in the PFTZ in the field of finance, customs, inspection and quarantine, maritime matter and border checkup;
7. Organizing and studying real time and follow-up monitoring and supervision of the relevant systems and measures in the PFTZ , and organizing its implementation;
8. Announcing to the public the information concerning the PFTZ and providing relevant consultation service; and
9. Other duties and responsibilities empowered by the Municipal People’s Government.
Article 8 The administrative commission delegates three representative offices, respectively as the PFTZ Tianjin Port section Office in the Tianjin Dongjiang Banded Zone Port Section Administrative Commission, as the PFTZ Tianjin Airport Section Office in the Tianjin Bonded Zone Port Administrative Commission (Tianjin Airport Economic Zone Administrative Commission), as PFTZ Binhai New Area CBD Office in the Tianjin New Area CBD Commercial Section Administrative Commission.
Article 9 The Tianjin Dongjiang Bonded Zone Port Administrative Commission (Tianjin Dongjiang Port Administrative Commission), Tianjin Bonded Zone Port Administrative Commission (Tianjin Airport Economic Section Administrative Commission) and Tianjin Binhai New Area CBD Commercial Administrative Commission shall be in charge of the concrete administrative management over the relevant sections and be held responsible for its corresponding administration.
Article 10 The Binhai New Area People’s Government shall, in accordance with relevant regulations, coordinate matters as stipulated in the provisions of Article 9 of these Methods concerning administrative commissions in implementation of the relevant plans of the PFTZ, land management, comprehensive traffic and major infrastructure construction, monitor of the financing platform, and the special funds for the development of the Binhai New Area.
Article 11 The powers catalogue and responsibilities catalogue of the administrative commission and its delegated offices, the concrete administrative powers, the duties and responsibilities to be held by them shall be announced exclusively by the administrative commission after the Municipal People’s Government decides
The administrative commission and its delegated offices shall, in accordance with the powers catalogue and responsibilities catalogue, exercise administrative powers and management responsibilities in a comprehensive and right way in accordance with law.
Where the administrative commission and its delegated offices readjust their administrative powers and responsibilities, the powers catalogue and responsibilities catalogue shall be timely updated.
Article 12 The Municipal People’s Government and its related departments shall, depending on the requirements of the PFTZ for reform and renovation, empower the PFTZ with the Municipal economic administration authority and other administration authority determined by the Municipal People’s Government in accordance with law.
Article 13 The PFTZ practices a relatively concentrated administrative licensing system. By which the administrative licensing organ shall exercise the relevant administrative licensing powers in a unified way in accordance with the regulation of the Municipal People’s Government. The PFTZ administers by way of administrative license catalogue, improve the service model of one stop administration at the multifunction function window, unify the standards for handling administrative licensing matters and simplify the procedure and make it easy for the applicant that may obtain the license on the spot or online.
Article 14 The PFTZ sections set up separate venues to offer administrative service, improve and gradually popularize the channels to handle matters online, offer convenient administrative service and accelerate the construction of administrative license service information system for the purpose of interconnection of administrative license information, credit information and monitor network, and of share of information.
Article 15 The PFTZ shall shift its focus from real time license to follow-up supervision and accelerate the construction of a system of norms and standards regarding the follow-up supervision.
The PFTZ practices a unified market supervision system, optimizes administrative procedure and administrative system by which to normalize production, operation, trade and other market activities in accordance with law.
Article 16 The PFTZ utilizes the citywide credit supervisory platform to improve the collection, application, storage, sharing and management of the credit information of the market subjects, sets up a sound record and disclosure system for the credit information of the market subject and its employees, pushes forward the interactive system of awarding the honest and punishing the dishonest.
Article 17 The PFTZ sets up a credit assessment standard for the market subjects and implements a classified supervisory system of monitoring market subjects for credit risk and selects the market subject by random sampling by proportion for checkup and places the market subjects with low credit rating under particular supervision and increases the intensity and frequency of check up against them.
Article 18 No on-the-spot inspection may be conducted in the market subjects in the PFTZ and market subjects shall be placed instead under supervision by means of information publication, appraisal of credit rating, online supervision and video monitor, with the exception of special fields for monitor and supervision such as firefight, safety in production and taxation. Where it is absolutely to conduct on-the-spot inspection, the inspection shall be conducted on a certain proportion of the market subjects as determined by their class of credit risk. The results of the inspection shall be announced in the unified credit supervisory platform.
Chapter III Open to Investment and Convenience in Trade
Article 19 The PFTZ shall open wider to attract foreign investment in an active and effective way in the field of shipping, commerce and trade, professional service, cultural and social service and other modern service industries and manufacturing industry, new generation information technology and other advanced manufacturing industry.
The PFTZ shall properly lower the threshold of entry including the qualifications for financial expertise and proportion of shares ownership and scope of business for the overseas investors, provided that the accompanying measures are in place.
Article 20 The PFTZ practices an administrative model of national’s treatment before entry plus the negative catalogue. In the fields not included in the negative catalogue, a file on the record administrative mode shall be adopted towards foreign investors, in the principle of equality between foreign and national capital, except for projects verified by the State Council preserved for domestic investors. A file on record administrative mode shall be adopted in the license of the establishment, change and contract of the foreign investing enterprises.
Article 21 Domestic and foreign enterprises are encouraged to set up regional headquarters, R& D Center, logistics center and settling accounts center in the PFTZ.
Article 22 It is encouraged to extend the value chain of the upper-end manufacturing industry to integrate and develop simultaneously with the modern service industry, to develop the repair businesses for high-tech and high added value products of both foreign and domestic enterprises and to study the ways to initiate the re-manufacturing business of high tech and high added value products overseas.
The administrative commission promotes financial products that meet the requirements of development of upper-end manufacturing industry such as patents rights, trade mark rights and share rights and mortgage loans, supports the upper-end manufacturing enterprises to expand channels of direct financing by way of IPO and financing, issuing private bond shares targeting the small and medium-sized enterprises, supports the upper-end manufacturing enterprises where ever it is possible to set up financial companies or financial service companies such as banks, financial companies, leasing companies and private small credit loan companies by way of buying shares.
Article 23 The PFTZ sets up a one- stop- shop window to do international trade by which the enterprises submit standardized electronic information and gets the results of the handling from the window.
The PFTZ sets up a comprehensive administrative and service platform served by multiple departments such as trade, transportation, processing, storage through which the departments exchange information, exercise supervision and mutual supervision and mutual assistance in law enforcement.
Article 24 This Municipality supports and encourages investors to use the PFTZ platform to join efforts in constructing the Silk Road Economic Belt and the 21st Century Maritime Silk Road. Investors in the PFTZ are encouraged to construct or cooperate with overseas investors in constructing a cooperative park so as to conduct cooperation with overseas investors in diverse forms.
The PFTZ sets up a stimulus system to cultivate and stimulate the overseas-bound cooperative enterprises. Measures such as publishing investment guide, offering training programs shall be taken to guide and help enterprises to familiar themselves with common international rules, normalize business acts overseas and make better investment decisions.
The PFTZ shall set up a unified service platform to help the overseas-bound enterprises in their overseas investment, improve the administration of overseas investment cooperation and service, set up a risk warning and emergency response system.
Article 25 The enterprises stationed in the PFTZ are encouraged to conduct domestic and international trade to facilitate the integrated development of domestic and overseas trade.
The administrative commission supports the transformation and upgrading of basic services such as international trade, storage and logistics and processing and manufacturing, and the development of service and trade.
The administrative commission encourages new types of trade businesses such as OFB trade, international bulk commodities trade, show and trade in bonded imported commodities, financing lease, bonded transaction in futures, cross-border electronic commerce, cultural service trade, green trade, parallel imported cars.
Article 26 The PFTZ shall, in accordance with state regulations, loosen the restriction for the proportion of foreign capital in the Sino-foreign joint, Sino-foreign cooperative shipping enterprises and allow foreign business to set up sole invested international ship administrative enterprises, to engage in international ship proxy businesses and the proportion of foreign share holding extended to 51 %.
The PFTZ shall aim at building a North China center for international shipping and finance by greatly expanding shipping finance, shipping insurance, encourage shipping intermediary organs such as domestic and foreign shipping insurance companies and insurance agent companies to set up business offices in the PFTZ and start operation.
The PFTZ shall apply a competitive international ship registration policy and Chinese investors shall, provided the international ship registration system is in place, have a share holding lower than 50%, to encourage the ships that meet the requirements to register in the PFTZ by making full use of the preferential tax policy given to the Chinese investor’s “flag-of-convenience vessel”.
The PFTZ shall improve the policy in favor of international cruise tourism, upgrade the supply service and improve the supporting facilities, set up the cruise onshore distribution and supply center and shore exploration sales center.
The administrative commission supports the seaports and airport located in the PFTZ to add new international passenger and cargo flights, increase international transfer business, and construct a maritime and air shipping center by exploiting the advantage of coordinated development of Beijing,. Tianjin and Hebei,
Article 27 The PFTZ shall create conditions to take over the shipping and logistics, space and air, equipment manufacturing, electronic information, biological medicine and other industries diverted from Beijing and Hebei. The administrative commission shall encourage the enterprises located in the Beijing, Tianjin and Hebei area to realize industry transformation and upgrading by means of cross-administrative region merger and regrouping.
The administrative commission shall, taking the chain of production as the key link, promote coordination and cooperation in R & D, production and sales, logistics, distribution and supply in the Beijing, Tianjin and Hebei area.
The administrative commission shall, through attracting upper-end industries to the PFTZ, promote the optimization of distribution of modern service industry, advanced manufacturing industry and strategic newly emerging industries in the Beijing, Tianjin and Hebei area, and create a renovated model of regional economic cooperation.
Article 28 The PFTZ shall offer convenience to the foreign nationals working in the enterprises located in the PFTZ and engaging in businesses in the PFTZ in entry and exit and residence.
The entry and exit administrative department shall offer convenience to Chinese nationals who work in enterprises in the PFTZ that need multiple entries and exits for business convenience
Chapter VI Innovation in Customs, Inspection and Quarantine
Article 29 No license administration shall be in effect in the export and import of merchandise between the special customs monitored area and foreign countries, and merchandise entering the special customs monitored area shall be reduced or exempted from the tariff or import tax, and merchandise going overseas from the special customs monitored area shall be exempted from export tax.
The merchandise going between the special customs monitored area and the other parts of China shall be subjected to administration according to the existing regulations.
The merchandise in the special customs monitored area may transfer freely. The products manufactured by enterprises inside the special customs monitored area for sale inside the area or exported overseas shall be exempted from value added tax and consumption tax and the merchandise transacted between enterprises inside the area shall be exempted from value added tax and consumption tax.
The non-special customs monitored area shall be administered according to the existing mode.
Article 30 As required by the convenience in clearing the customs, safety and efficiency, the PFTZ shall innovate customs monitor system and promote the development of a new trade model.
The customs shall practice a monitor system by the status of the merchandise in the special customs monitored area and by an encircled electronic administration. The merchandise going into or out of the special customs monitored area may first enter the area by producing the import shipping document and go through the import application procedures later step by step.
The merchandise plying between the special customs monitored area and other parts of China shall be administered by means of comparison of the export-import sheets in files on the record, accounts of the enterprise and internet electronic information. There is not time limit for the bonded merchandise stored in the special customs monitored area and the procedure in the special customs monitored area shall be simplified to allow the enterprise to declare several batches of merchandise at one time, transport the merchandise by themselves so as to facilitate efficient and convenient transfer of merchandise between the special customs monitored area and other customs monitored area.
The customs practices in the PFTZ adopt a paperless, low risk rapid passage mode, and guide more AEO (Authenticated Operators) to try the customs declaration mode of applying in advance and passing the customs as the merchandise arrives”, and effect a system of “declaring by oneself, pass the self-assisted customs and automatic verifying and re-checking”.
The customs shall, apart from the monitor system innovation, make innovations in other aspects as required by the actual needs of the PFTZ.
Article 31 The PFTZ shall practice an innovative quarantine supervision system in the PFTZ in the principle of “convenience in entry and exit and assurance of safety’.
The PFTZ shall set up merchandise random check system based on a particular enterprise’s credit appraisal. The quarantine and inspection department shall, except for waste raw material, hazardous chemical articles,, packaged or bulk merchandise, practice on the spot inspection a mode of “quarantining the import merchandise as usual and properly loosen the quarantine of export merchandise”, innovate the quarantine technology and methods, and on the backstage practices a mode of “convenience in entry and exit, strictly prevention of quality safety risks “.
The merchandise in the exit section of the special customs monitored area shall, in accordance with the application of the enterprise, effect a pre-examination system by which to examine at one time and let go in batches. The merchandise entering and exiting the special customs monitored area for the purpose of bonded commodities show shall be exempted from inspection.
The transfer of merchandise between enterprises stored in the customs special monitored area shall be exempted from inspection and quarantine.
Ships plying international waters that enter the customs special monitored area shall be quarantined by telegraph or on shore quarantine and may not be, on the whole, to be quarantined at the anchorage area.
The PFTZ practices an administrative system conducive to the normal development of third party inspection and evaluation. The inspection and quarantine department shall, abiding by the internationally applicable rules, accept the results of the third party inspection and examination.
Article 32 Where a financing lease enterprise registered in the special customs monitored area imports and exports airplanes, ships and ocean engineering structures and other large sized equipment that involve more than one customs offices, it shall be administered as required by the actual need of logistics, by entrustment of customs office in another place, provided the administration is effective and the current taxation policy is implemented.
Article 33 Integration of seaports and airports in the Beijing, Tianjin and Hebei area shall be accelerated and the seaports and airports of the three places shall be developed simultaneously in the principle of complementary development and giving full play to each other’s advantages. The bonded logistics network with Tianjin Harbor as the exit to sea shall be improved and the policy of settlement of accounts by will and other innovative policies shall be radiated and extended to Beijing and Hebei and the hinterland. Beijing and Hebei are supported to set up exclusive logistics park in the PFTZ to facilitate the modern logistics business.
The distribution of waterless ports shall be prioritized so as to accelerate the cooperation in customs declaration between the Tianjin port and hinterland ports. The multi-mode integrated transport system shall be improved, by making use of on the Euro-Asian land bridge, to strengthen the transfer trade function of the Silk Road Economic Belt and the 21st Century Maritime Silk Road serving the countries and regions along the Roads.
Chapter V Innovation in Finance Service
Article 34 The PFTZ accelerates the marketization of interest rate, piloting the issuance of transferable large sum bank accounts.
The PFTZ shall set up on a trial basis the RMB exchange on capital project with a ceiling to the amount and the organs stationed in the PFTZ that meet the requirements may conduct direct investment, merger and debt tool, and other transactions in financing investment.
Enterprises are encouraged to conduct in cross-border financing by making use of domestic and foreign sources and markets, so as to lower the cost of financing. Units and individuals are encouraged to invest in the two-directional securities and futures markets in accordance with the regulations. It is supported to promote trials in the convenience of cross-border financing and exchangeable capital projects through free trade accounts or other modes of controllable risk.
Article 35 it is to loosen the restrictions on license and size for enterprises located in the PFTZ to issue treasury bonds both in RMB and foreign currencies. The PFTZ shall set up a broad and careful foreign debt administrative system and practice a unified foreign debt policy for both domestic and foreign enterprises and explore foreign currency administrative mode that is conducive to commercial insurance for finance.
Article 36 It is supported to set up foreign invested banks and Sino-foreign joint invested banks. The non-governmental capital may inaugurate in the PFTZ small and medium sized banks and other financial institutions in accordance with law, and set up restricted license banks on a trial basis.
It is allowed for the Chinese invested banks in the PFTZ that meet the requirements to run OFB business.
Article 37 The PFTZ shall conduct cross-border reinsurance business and major disaster insurance business on a trial basis and set up a regional reinsurance center for shipping and insurance for risks of major disasters.
The PFTZ shall allow the foreign enterprises located in the PFTZ to participate in the commodities futures trading on a gradual basis.
Article 38 The PFTZ pushes forward the innovation in the lease industry, establishes a state lease innovation demonstration zone, supports the setting up of the China Finance Lease Research Institute and other research institutes so as to create an environment conducive to a lease industry with international practice.
It is supported to set up a China (Tianjin) Lease Platform and China Finance Lease and Registration, Transfer Platform, through which to register, announce and transfer the capital for lease on a trial basis.
The lease industry is supported to engage in overseas financing, and lease companies of all kinds are encouraged to expand the scope of cross- border use of RMB capital.
The finance lease companies and financing lease companies are encouraged to set up branches and project companies, so as to engage in the financing lease business in large equipment, complete set equipment and launch domestic and overseas lease business.
Article 39 The trading markets in the Beijing, Tianjin and Hebei area shall be further connected and engaged in more extensive new type of exchange markets ranging from property right, technology, pollutant discharge right, to carbon discharge right with the aim of pushing forward the reasonable, effective interflow of all kinds of resources.
The financial institutions located in the PFTZ are encouraged to explore innovations in products and administrative modes that fit in the coordinated development of the Beijing, Tianjin and Hebei area.
Article 40 The PFTZ shall set up a risk prevention system that is compatible with the development of finance businesses. The administrative commission and related departments shall, in collaboration of financial administrative departments, improve the risk monitor and evaluation mechanism.
Chapter VI Developmental Environment
Article 41 The PFTZ shall set up an linkage mechanism with the state initiative and pioneering demonstration zone and by making full use of the radiation policy of the state initiative and pioneering demonstration zone to attract elements of upper-end technology, explore new modes of regional cooperation and establish the regional innovation platform with the function of demonstration and powerhouse.
Article 42 The PFTZ shall implement the risk compensation mechanism on loans to small and medium-sized enterprises and encourage banks and other financial institutions to provide loans to small and medium-sized enterprises. The administrative commission shall actively develop credit-based insurance, encourage insurance and financial institutions to provide insurance service to small and medium-sized enterprises, set up a subsidy mechanism for the insurance risks on loans and encourage the insurance companies to develop insurance products in serving small and medium-sized enterprises.
Article 43 The PFTZ shall strengthen unified planning and coordination, encourage and support all kinds of vocational schools, vocational skill training institutions and employing units to innovate the mode of training to launch training programs with market need orientation and in the direction of the industry’s development, encourage the laborers to participate in vocational training to raise vocational skills, increase employment and pioneering abilities. Subsidies shall be handed out to those who obtain vocation qualification certificate.
Article 44 Industry associations and chambers of commerce are supported to take part in the innovative development of the PTFZ. The enterprises and related organizations located in the PFTZ are encouraged to express their interests and requests and take part in policy evaluation and market supervision on a trial basis.
Lawyers’ offices, accountant’s offices, taxation lawyers’ offices, intellectual property rights service institution, customs declaration organ, inspection and examination organs, authentication organs, ship and sailor agent, notary public organ, judicial evaluation organ, credit service organ and other profession organs are encouraged to launch their business in the PFTZ.
Article 45 The PFTZ shall explore ways to evaluate talents according to international practice, design more active policies to attract and stimulate talents with an innovative edge, and build a special zone with a concentration of international talents.
The PFTZ shall adopt measures to determine and stimulate high caliber foreign talents, and provides special policies to the high caliber foreign talents in terms of entry and exit, visa and stay, application for projects, innovation and pioneering, evaluation and stimulation, and service assurance
A pilot area of comprehensive reform on education internationalization shall be set up to attract high quality teachers, and run schools on a cooperative basis in the area.
Article 46 The PFTZ shall, in accordance with state regulations, implement taxation policies aimed at promoting investment and trade, carry out taxation policies that facilitate the investment by overseas shares and development of OFB businesses, set up a convenient taxation service system and create a taxation environment conducive to fair competition.
The PFTZ shall, in accordance with state regulation, replicate and disseminate the taxation policies currently in use at the China ( Shanghai) Pilot Free Trade Zone.
The taxation department shall use the information-sharing platform to analyze the taxation information and PFTZ supervisory information to monitor the taxation risks so as to raise the management level of tax collection.
Article 47 The PFTZ shall set up a North China operational center of intellectual property rights to conduct cross-border transfer of intellectual property rights, innovate the mode of investment by intellectual property rights, push forward the establishment of a handling mechanism for intellectual property rights and its materialization, improve the administrative and implementing system of intellectual property rights and formulate a handling mechanism for settling dispute involving intellectual property rights.
Article 48 The environmental protection endeavor in the PFTZ shall be strengthened. The enterprises located in the PFTZ are encouraged to apply for the international environmental standards and energy administrative system authentication currently in use, adopt advanced production technology and techniques, conserve energy, reduce pollutants and green house gas discharge.
Article 49 An evaluative system shall be set up in the PFTZ by which to make comprehensive and special evaluation of the implementation of the policies in practice on a trial basis according to state regulations. Wherever it is necessary a third party evaluation organ shall be entrusted to conduct an independent evaluation. Where achievements in the trial project produce good effects and are capable of replication and dissemination, they shall, upon the approval of the State Council, be replicated and disseminated in the Beijng, Tianjin and Hebei area first, where the conditions are ripe, they shall be disseminated in other parts of China.
Article 50 Any party of a business dispute involving enterprises or individuals in the PFTZ may bring a lawsuit to the people’s court in accordance with law or apply for arbitration or business settlement.
The PFTZ is encouraged to introduce a dispute settlement mechanism of arbitration and business settlement that is currently in practice internationally, so as to solve business dispute in the PFTZ in a flexible and high efficient way.
The financial trade association, self-disciplinary organization are encouraged to launch professional mediation in accordance with law and set up a connecting mechanism between mediation on the one hand and arbitration and law suit on the other.
Article 51 An anti-monopoly mechanism shall be established in the PFTZ. Where there is a concentration of operators of a trade and reaches the State Council standard, the operators shall first apply and may not operate in a concentrated way without application. Where acts involve agreement aimed at monopoly, abusing the dominant position in the market or abusing administrative powers to eliminate or restrict the operator’s competitive edge, they shall be investigated and law enforced.
Article 52 The PFTZ has in place an examination system targeting foreign investors for state security and the foreign investors that fall into the scope of examination shall cooperate the related department of the state in the state security examination
Chapter VII Supplementary Provisions
Article 53 Where it is stated otherwise in the provisions of other regulations of this Municipality, the provisions of these Methods shall prevail.
Article 54 These Methods shall enter into effect as of April 21, 2015.
